Coffee Bean & Tea Leaf is intentionally misleading and shortchanging consumers by falsely and deceptively misrepresenting the amount of product actually contained in the powder tins. The size of the containers leads the reasonable consumer to believe that he or she is paying for more product than he or she receives. However, the containers are under-filled by over 55%. Less than 45% is filled with powder, and the rest is empty space, or “slack-fill”, which serves no legitimate or lawful function.
At the expense of consumers’ wallets, nonfunctional slack-fill like the type used by Coffee Bean allows businesses to reduce their food production costs and profit from the empty space.
